Terms of Service

Bounce Design provides freelance technical web development, SEO/GEO, server performance optimisation, website maintenance, and related consulting services. Each engagement is confirmed through a written proposal, statement of work, or email agreement that specifies the scope, timeline, deliverables, and fees.

Work begins once the scope and fees are agreed in writing, and any required deposit or onboarding information has been received. I work as an independent contractor, not as an employee of the client. Unless otherwise agreed, I retain the right to work with other clients during the engagement.

The client agrees to provide timely access, content, credentials, feedback, and approvals needed to complete the project. Delays caused by missing client input may extend the timeline. The client is responsible for ensuring they have the right to provide any materials, content, or branding used in the project.

Payment terms are set out in the project proposal or agreement. Deposits are generally required before work begins. Ongoing retainers are billed in advance. Because work is bespoke and time-based, deposits are non-refundable once work has commenced. Any refund requests will be considered on a case-by-case basis.

Upon full payment, the client receives ownership of the final deliverables created specifically for the project. I retain ownership of pre-existing code, tools, frameworks, processes, and general know-how. Third-party assets, plugins, or libraries may remain subject to their original licensing terms.

I deliver services with reasonable care and skill. However, I cannot guarantee specific search rankings, traffic levels, conversion rates, or business outcomes. My liability is limited to the fees paid for the services in question, and I am not liable for indirect, consequential, or loss-of-profit damages.

I respect client confidentiality and will not disclose proprietary information, login credentials, or sensitive business details without permission, except as required by law or to deliver the agreed services.

Either party may terminate an engagement with reasonable written notice. In the event of termination, the client remains liable for fees for work completed up to that point and any non-refundable expenses incurred.

These terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved through good-faith negotiation.
